A will is a legal document that is generally prepared by an attorney and signed in the presence of witnesses by which you set forth your wishes regarding the distribution of your assets at the time of your death. A will also allows you to name a person to be the guardian of any minor children you may have at the time or your death, and to appoint a trustee to handle any monies that you may leave to a minor.

You appointment an individual to be your representative to handle the processing of the assets to be distributed as per your wishes and to pay any debts you may have at the time of your death. After the payment of taxes, funeral expenses and attorney fees the remainder of your estate will be distributed by your representative in accordance with you wishes.

If you do not have a will at the time of your death, the state law will control the distribution of your estate.


A power of attorney is a document that allows you to designate a legal representative to act on your behalf if you were to become incapacitated, incompetent or disabled. You choose what powers you wish to give to your representative. You may limit the powers to certain areas or give full power to the act in any legal capacity.

A power of attorney may be withdrawn at anytime by you, and it automatically ceases to exist upon your death. If you are older this instrument can be helpful in protecting your assets if you are unable to act on your own behalf.


A health care proxy gives an individual the designated authority to make decisions regarding your health care should you become unable to make your own decisions. This is a serious undertaking and you should consider if the person you wish to have this decision- making power is capable of doing so. This individual may be called upon to make a significant amount of decisions regarding your health care options.

The proxy applies to all kind of medical care including artificial nutrition, breathing apparatuses, and medication. You decisions in these matters may be identified in a document called a Limedical treatment.
